These Terms of Service (“Terms”) govern access to and use of the Mission Real Estate platform, website, mobile app, and related services (collectively, the “Service”), operated by Mission Real Estate Services, Inc. (“we”, “us”, or “Mission Real Estate”). By creating an account, logging in, or otherwise using the Service, you agree to be bound by these Terms.
The Service is intended for licensed California real estate agents and brokers, their support staff, and the clients they serve. You must be at least 18 years old and have the legal capacity to enter into these Terms. If you are using the Service on behalf of a brokerage, you represent that you have authority to bind that brokerage to these Terms.
You are responsible for maintaining the confidentiality of your login credentials, for all activity that occurs under your account, and for keeping your contact information current. Do not share your account with anyone else. Notify us immediately at thecrmplus@gmail.com if you suspect unauthorized use.
You agree not to (a) use the Service to send unsolicited marketing SMS, unlawful communications, or communications that violate the Telephone Consumer Protection Act, CAN-SPAM, or California CCPA/CPRA; (b) upload malware or attempt to disrupt, probe, or reverse-engineer the Service; (c) scrape, harvest, or export contact data belonging to another agent, another brokerage, or a person who has not consented; (d) misrepresent your identity or your license status; or (e) use the Service to violate the National Association of Realtors® Code of Ethics or any California Department of Real Estate rule that applies to your license.
The Service integrates with third-party providers (Twilio for voice and SMS, Google and Microsoft for optional email and calendar sync, Stripe for billing, OpenAI for optional AI features) to deliver core functionality. Use of those integrations is subject to the third party’s own terms and privacy policy. You authorize us to send the minimum data required to operate the feature you have enabled. AI features are off by default and require explicit opt-in.
You retain ownership of the contacts, transactions, and communications you upload or generate through the Service. You grant Mission Real Estate a limited, non-exclusive license to host, process, and display that data solely to provide the Service to you and to your authorized team members. You are responsible for having a lawful basis (consent, contract, or legitimate interest) to store each contact, and for honoring opt-out and deletion requests from those contacts.
Paid features are billed on a recurring basis through Stripe on the web at https://www.thecrmplus.com. You may cancel at any time from your account settings; cancellation stops future charges and takes effect at the end of the current billing period. Charges already incurred are non-refundable except where required by law. Subscription management is not available inside the iOS app.
We may suspend or terminate your access to the Service if you materially breach these Terms, if your use puts other users or third parties at risk, or if we are required to by law. You may stop using the Service at any time and request account deletion by emailing thecrmplus@gmail.com. Deletion follows the retention rules in the Privacy Policy.
The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. Real estate outcomes depend on many factors outside our control; the Service is a tool, not a guarantee.
To the maximum extent permitted by law, Mission Real Estate and its officers, employees, and contractors will not be liable for indirect, incidental, consequential, special, or exemplary damages, or for lost profits, lost data, or lost business opportunities, arising from or related to the Service. Our aggregate liability for any claim arising from or related to the Service is limited to the greater of one hundred U.S. dollars (US$100) or the fees you paid us in the twelve months before the event giving rise to the claim.
These Terms are governed by the laws of the State of California, without regard to conflict-of-laws principles. Any dispute arising from or related to these Terms or the Service shall be resolved in the state or federal courts located in Los Angeles County, California, and you consent to personal jurisdiction and venue there.
We may update these Terms from time to time. Material changes will be posted here with an updated “Last updated” date, and, where practical, announced inside the Service. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
